These General Terms and Conditions apply to European users.

Article 1 – SCOPE

These General Terms and Conditions only outline the framework for the commercial relationships that may arise between a member and VIP Outlet and the use of the Website www.vipoutlet.live. They take precedence over any other general or specific condition.

Article 2 – ACCEPTANCE

The use of the Website www.vipoutlet.live or the placement of an order with the company VIP Outlet implies that the member or customer accepts these General Terms and Conditions unconditionally and unequivocally.

Article 4 – DEFINITIONS

Services: all of the services that are offered by the company VIP Outlet on its Website in general and the sales of goods and services via the Internet.

Member: any person who has registered on the VIP Outlet Website in order to receive communications published by VIP Outlet about the Services and/or Sales that will be offered on the Website. After registration on the site, VIP Outlet will keep the Member informed of the Livestream events, Services and/or Sales offered by emails, Facebook and Instagram from which the Member can unsubscribe at any time.

Customer: any Member who enters into a commercial relationship with VIP Outlet by purchasing a product or service via the website of VIP Outlet. A customer is deemed to be authorized to make this purchase, and to be authorized to enter into a commercial transaction with VIP Outlet. A customer must be at least 16 years old and may not be acting in the performance of a profession or a business.

Supplier: any company that has mandated VIP Outlet to sell or promote its products through the Website of VIP Outlet.

Order: any order that is placed by a Customer in accordance with the terms described in Article 6.

Article 5 – REGISTRATION

To access the Webshop www.vipoutlet.live you need to be a Member.

You can become a Member by registering on the Webshop, possibly after being invited to do so by  an existing Member. Once you are registered an account is created for you on the Webshop (“Member Account”).

Each time you enter the Webshop you need to enter your user name (which corresponds to your email address), and your password or login via your Google or Facebook account. Your Member Account is strictly personal. You are responsible for any action being taken on your Member Account.

VIP Outlet retains the right to refuse or to cancel the registration of a Member, to close a Member Account and/or to exclude a Member from further access to the Webshop.

VIP Outlet gives you the opportunity to invite friends and family to also become a Member. However, in order to preserve the exclusive character of our Services, invitations must be limited to your circle of family and friends. Inviting people outside your circle of family and friends in large numbers, in whatever way, is prohibited.

If VIP Outlet is noting irregularities on the part of the Member in his use of the “Invite-a-friend” system, any suitable measures to stop these irregularities can be taken; this may go from taking away certain benefits to closing the Member Account.

VIP Outlet also retains the right to close a Member Account if that Member is seen to be using proxy IPs (Internet Protocol Addresses) in order to attempt to hide the use of multiple accounts or disrupt any of our Services in any way.

Article 6 – ORDERING

You must be of legal age to place an Order on VIP Outlet. Minors or other persons who are not of full legal capacity must be represented by their parents or a legal representative, who shall also be bound by our general terms and conditions and sales conditions.

The products and services as defined in Article 4 are offered for sale through the website www.vipoutlet.live. Irrespective of any written evidence that the Customer may possess, it is expressly agreed that only the data that are recorded in the computer system of VIP Outlet, its hosting partner or its Internet payment service provider will serve as proof of the communications, the contents of the Order and the entirety of the transactions that have taken place between the parties. In all cases the Customer shall receive a confirmation of his/her Order via email after the purchase, and a second email at the time of shipment of the Order by VIP Outlet. All contractual information regarding the Order is communicated to the Member in the language chosen by the Member at the time of his/her registration. This information shall be reconfirmed once more by email and on paper at the latest upon delivery of the Order to the Customer, in accordance with Article 9 of these General Terms and Conditions.

Article 7 – PRICES AND PAYMENT METHODS

The prices that are listed during the purchasing process are in EURO and are inclusive of VAT, service charges and any other additional costs and/or charges, unless explicitly stated otherwise. The applicable VAT rate on the Netherlands is used.

VIP Outlet reserves the right to change the outlet prices at any time. However, the purchased products and services shall always be billed -except manifest error of the price in the Webshop – at the prices listed in the Webshop at the time an Order was placed. These are the prices that were applicable at the moment of purchase. The products remain the property of the Supplier until they have been paid in full by the Customer. VIP Outlet reserves the right to refuse any Order of a member with whom a dispute exists or with whom a dispute has arisen in the past.

You can only pay your Order online and using credit or debit card (VISA, American Express, MasterCard, iDEAL, Sofort, PayPal and AliPay) or in arrears within 14 days of receiving the Order confirmation and invoice, which will contain instructions at to how payment should take place.

The Customer’s bank account shall be debited after confirmation of the purchase and the payment shall be effective only once the Customer’s bank has given its consent to VIP Outlet . If the Customer’s bank refuses the payment, the Order shall be cancelled automatically. In case of unavailability of servers, VIP Outlet reserves the right to re-apply for authorization.

In case of use of your right of withdrawal or a good is returned based on defects, unless you make an explicit request to the contrary, your refund will be paid on the same card or the same account that you used to pay the Order. If you choose, this amount can also be paid into your customer account with VIP Outlet and can be used for future purchases in the Webshop.

Customers warrant that they are authorized to execute online payments using one of the aforementioned payment methods and that there are sufficient funds in the bank account linked to the credit card, iDEAL, Sofort, PayPal or AliPay account to cover all costs arising from the transaction. Entering confidential payment information on the website of VIP Outlet is extremely secure thanks to the use of SSL encrypting (Secure Socket Layer).

For the processing of online payments VIP Outlet cooperates with Stripe. The security system used by Stripe is one of the most reliable and secure in the world. VIP Outlet has entered into a data processing agreement with Stripe.

VIP Outlet has no access to the confidential payment data of its Customers. The confidential payment data (bank cards, expiration dates, security codes) are accessible to the company Stripe only. They are not stored with VIP Outlet . For this reason, the Customer’s payment details have to be requested every time a purchase is made.

Members have the possibility of associating with their «member» account their payment method which will be treated, in a secure way, by our partner Stripe. In this way it will be no longer necessary to introduce their data during each purchase.

By clicking the “Order” button on the Webshop, you unconditionally accept our Terms and Conditions and our Privacy Policy as a whole and in their version into force at the moment you place your Order.

Failure by the Member to respect our Terms and Conditions, and especially in case of fraud or attempt of fraud, and in case of any other payment dispute, could result in (i) the suspension of the Member’s access to the Webshop and the Services, or (ii) the cancellation of the Member Account, without prejudice for any damages that VIP Outlet could claim. Therefore, VIP Outlet retains the right to refuse to fulfil any Order of a Member with whom such dispute exist.

Furthermore, in the event of a manifest error in a price advertised on the Webshop, VIP Outlet will not be bound, in accordance with the principles of case law currently in force, to deliver the goods purchased to Members at the “manifestly” incorrect outlet price. If the Member so wishes, he may however have the goods delivered to him at the actual outlet price which should have been announced.

Article 8 – AVAILABILITY

The goods, as well as the prices, are valid, except manifest error, as they are shown on the website of VIP Outlet, within the limits of availability of these goods at the supplier. VIP Outlet commits itself to making every effort to deliver all of the Orders. Nevertheless, VIP Outlet cannot be held responsible for the unavailability of a good at the supplier’s nor for any damage that could result from it. In the event that one or more goods within an Order are not available, the Customer shall be notified by email or telephone that his/her Order shall be cancelled in whole or in part. In the event that the unavailability is established and communicated when the Customer has already paid for his/her goods, VIP Outlet shall immediately request its bank to refund the paid amounts. The Customer shall be informed of this by email. The time period within which the money shall be paid back effectively depends on the payment method that the Customer has used to make his/her purchase. If the purchase was made with a credit card, the refund will show up on the next monthly credit card overview. If the Customer is of the opinion that reimbursement takes abnormally long, it is recommended that the Customer contacts his/her bank.

Article 9 – DELIVERY

The orders are delivered at the delivery address that was specified by the Customer during the ordering process and according to the conditions described therein.

Orders can be delivered only to addresses in Germany, Belgium, the Netherlands, with the exception of P.O. boxes. The place of residence of the Customer is irrelevant. VIP Outlet reserves the right to split up the Order into one or more deliveries depending on the availability of the products. If the Member so wishes, in the event of absence during delivery, he may inform VIP Outlet and/or the carrier that the goods can be delivered to a predefined location or to another address that the Member has previously provided.

The delivery is accompanied by a delivery note, which also mentions the details of the delivered goods. The delivery is offered to the Customer or any other person present at the delivery address who has authorization to receive the package.

If no one can accept delivery of the package when it is offered, the carrier will leave a message in the mailbox stating the name and contact details of the carrier. The Customer must then contact the carrier to check where and when the Customer can pick up the package. VIP Outlet ensures that the order is processed in the shortest possible time.

The delivery period of 14 days after the end of the online sale is a target date and purely indicative.

Under no circumstance can VIP Outlet be held responsible for any delay in the delivery of goods or services, nor for the damage that could result from it.

Article 10 – NON CONFORMITY

All goods that are offered for sale on the website of VIP Outlet are described in good conscience and as faithfully as possible. However, the photographs that are shown on the website have no contractual value. VIP Outlet disclaims any responsibility for errors that may occur in the descriptions of the products or services or in the photographs. Nevertheless, VIP Outlet commits itself to correct any errors that are reported in writing as soon as possible and in as far as possible.

If a good that is delivered doesn’t match the description on the delivery note or is otherwise defective you should as soon as possible and in any case within 2 months after discovery notify us using the “report defective goods” form available in the My Account section => My Orders from the VIP Outlet site. You will then receive further instructions as to how to proceed.

Article 11 – RIGHT OF WITHDRAWAL AND RETURN POLICY

A Customer may cancel any Order at any time and without cause within 14 days of the Order using his/her right of withdrawal. The Customer can use this right by:

  • using the return form; you find this form in the Q&A section in the website.; or
  • completing and signing the template form of withdrawal ; or
  • sending any unambiguous statement setting out the Consumer’s decision to withdraw from the Order.

The right of withdrawal does not apply to:

•   sealed goods if the seal has been broken following delivery, e.g. perfume, cosmetics, audio and video recordings and software; and

•   perishable goods.

A Customer may further return goods if the goods are defective. After a claim is made and assessed based on article 10 of these terms and conditions and VIP Outlet has confirmed to the Customer the goods can be returned.

Only returns approved by VIP Outlet and send in accordance with the return instructions of VIP Outlet will be accepted and processed.

All goods returned to VIP Outlet should be packaged to prevent damage in shipping. VIP Outlet assumes no liability for damage to goods shipped to VIP Outlet. Goods must be returned as new, in their original packaging, in perfect condition  (or in case of a defect in the condition as received) and accompanied by the invoice and a completed return document.

After receipt of the returned goods, VIP Outlet shall as soon as possible and in any case within 14 days refund the Customer in accordance with article 7 of these terms and conditions.

The returned item must be sent to the address in the address in the Q&A.

Article 12 – WARRANTY

We guarantee that our goods conform to your Order and meet the normal expectations that you may have, taking into account the specifications of the good. Obviously we also guarantee that the goods meet all of the laws that are in force at the time of your Order. Furthermore, we use the statutory minimum warranty period of 2 years for the delivery of goods if the goods are not in conformity with the Order that was placed. This means that in the case of faults of or defects to the goods, it shall be repaired or replaced free of charge up until 2 years after delivery. To the extent possible and reasonable, you shall have a choice between repair and replacement. Only if repair or replacement is excessive or impossible or cannot be performed within a reasonable time, shall you have the right to demand a price reduction or rescission of the purchase contract. In any case, the warranty does not apply to goods that were damaged on purpose or due to negligence (breakage, moisture, unsuitable temperature, corrosion, ingress of fluids, power surges, fire, or any other form of force majeure) and goods that have clearly been repaired and/or modified by a repairer who was not authorized by VIP Outlet. Similarly, the warranty does not apply if the damage is the result of wear, transport, misuse and/or non-conformance to the instructions in the manual. If none of the above-mentioned exclusions apply to the good, the warranty must be claimed within 2 months after discovering the defect. Article 13 – INTELLECTUAL PROPERTY RIGHTS

VIP Outlet is in no way responsible for the content of third party websites to which VIP Outlet links on its website, in particular with regard to compliance with the protection of privacy and personal information. VIP Outlet cannot be held liable for any errors in the photographs or texts that are used in the descriptions of the goods on the website of VIP Outlet .

VIP Outlet cannot be held liable for the inability to deliver the ordered goods, incases of force majeure, such as disruption or cessation of transport, mail or communication services, flooding, fire, etc.

VIP Outlet disclaims any liability for any damage that is caused by a defect, malfunction or improper use of a good that was sold on the website of VIP Outlet  except in case of fraud or serious misconduct by VIP Outlet , its agents or its representatives.

In all cases where VIP Outlet is held liable, the liability of VIP Outlet shall be limited to the amount that the Customer has actually paid for an Order, except in the event and to the extent that the exclusion of such liability is prohibited by law, e.g. in case of death or bodily harm.

VIP Outlet is in no way responsible for the content of third party websites to which VIP Outlet links on its website, in particular with regard to compliance with the protection of privacy and personal information. VIP Outlet cannot be held liable for any errors in the photographs or texts that are used in the descriptions of the goods on the website of VIP Outlet .

Article 15 – DISPUTES AND APPLICABLE LAW

Any dispute regarding the use of the services defined in Article 4, and with respect to these General Terms and Conditions, is subject to Dutch law. In the case of a dispute, only the court in Amsterdam is competent.

Article 16 – AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

VIP Outlet may modify these General Terms and Conditions at any time, amongst others things in order to comply with legal obligations. Members will be notified adequately of any changes to the General Terms and Conditions via the section “Help & Contact” on the website of VIP Outlet , or in another way. Members commit themselves to take note of the changes as soon as they are made aware of them. Any use of the services described in Article 4 after VIP Outlet has communicated the modified General Terms and Conditions assumes the acknowledgement and endorsement of the modified General Terms and Conditions. VIP Outlet reserves the right to modify the design and content of its website at any time. Insofar as possible, VIP Outlet shall communicate every significant change to its Members. Members have complete freedom to deactivate their account upon a change to the General Terms and Conditions, or to the layout or content of the website of VIP Outlet . They can do so in the section “My Account” on the website of VIP Outlet by clicking “My Personal Information”. If an article or section of these General Terms and Conditions should be declared void or non-enforceable by a decision of a court, this does not in any way lessen the validity and applicability of the other articles and sections of these General Terms and Conditions.

ARTICLE 17 – PREVENTION OF COUNTREFEIT

VIP Outlet at all times only offers outlet products that it purchases from distributors who confirm that these are original products and not counterfeit. When in doubt about the authenticity of products, the consumer can contact us via contact@vipoutlet.live

ARTICLE 18 – COMPLAINTS

Customer satisfaction has top priority for VIP Outlet . We therefore always ask each Member of VIP Outlet who has a question or complaint to contact our customer service staff. They are available each working day by email or live chat via the link “Help & Contact”, which can be found on every page of the website.

ARTICLE 19- TERMINATION OF MEMBERSHIP

Members can terminate their membership at any time by closing their account or by sending an email to: contact@vipoutlet.live Notification preferences can also be adjusted at any time, in the section “My Account” > “Personal Information” on the website.
